is incorrect xhtml, because there is a body without a head.

Where are you seeing this? That script is added directly after the body intentional as this is how FBC API works and is how FB has instructed it be added. FBC has nothing to do with rendering the Head of your page; this is more so the doing of your template and it properly having the head tag.
