Paid Subscriptions => Mailer => Add New Mailer
Message Type = Email
Apply email / PM Template = Yes
Subject = We would love to see you come back
Main Mailer Triggering Conditions
Automatically send message at following date = 30 days after
Relative to this date of the plans below = Members's Last Online Date
Existing subscriptions and CB Fields and Dates conditions
Any of the following plans subscriptions= --- None is needed ---
Date A, Field A or Value A = Following CB field
CB Field A = cd_emailnotifications
Date B, Field B or Value B = Constant Value or String (CB substitutions can be used)
Value B = Yes
What do we need to add here to test if the user account is banned?

You shouldn't need to add anything. It shouldn't email blocked accounts. Banned accounts can still login fine as it's just a profile ban so it may still email them.

It has been thus why i asked the question, we have found a fix, i have created an auto action, that when a member is banned two things happen, one they are moved into the user group 'Banned' and then we have a newsletter subscription feature, we update this to 'Do NOT email me newsletters'
This has effectively fixed the issue.
Bit of a work around, but because we cannot check if a user is blocked or banned within the mailer this was the best solution
