emails not being sent if contain upper case letter

scanned forums and found nothing on this...

does CB not send emails with capital letters? I inserted a bunch of users at one point, so maybe that's how they got in there or does CB not allow upper case in the email?

This is only the case if you're NOT using CB 1.4. Previous releases have case sensitive email validity REGEX. This is not the case in 1.4 where it is case insensitive.

I am but I'm using another extension to email - so maybe that's the issue. does CB put them into lower case when user saves?

If you're using another extension to email then that extension is probably the problem. Please test with CBs Mass Mailer in user management and emails should send just fine regardless of case. No, CB does not lowercase emails on save.

can I change the regex to only allow lower case - if so, how?

Yes, but I don't recommend doing so. You'll need to edit the define _UE_PREGMATCH_VALID_EMAIL in comprofiler.class.php and at the very end you'll see an "i" (without quotes), simply remove this and it removes case insensitive flag making only lowercase valid.

This doesn't seam logical however, this is a bug in your 3rd party extension which you're trying to fix through CB. You should contact the developer of your extension and have them fix their mailing function, capitals are completely valid in emails.
