An image field is never truly empty. It'll return the dummy image file (e.g. DOMAIN/components/com_comprofiler/plugin/templates/default/images/avatar/nophoto_n.png) as its value so you'll need to check for that. The below condition I've confirmed works fine.
Operator: Is REGEX
Value: /nophoto_n.png|tnnophoto_n.png/
Operator: Is REGEX
Value: /nophoto_n.png|tnnophoto_n.png/
