EU Cookie Law

11 years 10 months ago #203093 by philhfr
EU Cookie Law was created by philhfr
Hi

The UK has brought in the EU directive on requiring all users to opt in to all websites’ use of cookies. There seem to be a number of potential solutions available (e.g. Cookie Monster, Cookie Alert, etc …).

Although this is a wider Joomla issue, do you know if any CB/CB-Subs sites have implemented any of these successfully (or do you recommend any particular solution)?

Cheers
Phil

Can you site the source of such law with details regarding said law? This doesn't some entirely correct; I don't see how all sites on the internet could be cookie opt in. The easiest solution is just add it to your terms and conditions, which is required to be accepted during registration.

With a quick search was able to find the following information regarding the "E.U. Cookie Directive".

www.seoptimise.com/blog/2012/03/eu-cookie-directive-what-why-who-when-and-how.html

All you need to do is add a segment to your Terms and Conditions (Terms and Conditions must be accepted to register, so it counts as "opt in") stating what cookies are being used for (login session tracking) and you're fine. Joomla just uses a cookie to link a session ID and a user. It stores everything to a database driven session rather then a cookie.

There are also several posts on Joomla forums regarding this with dozens of solutions available.

It's safe to assume this law won't be enforced and likely won't last long. Many EU politician websites as well as EU government website aren't even complying with the new law. It's also completely unenforceable for websites outside of EU (host your site in the US for example) regardless of how they word the law they've no jurisdiction outside their own country to enforce this (no judge will hear it and it'd be thrown out). As I am in the US there's nothing I can do regarding this, but I urge all EU citizens to fight such a law.

Hi Phil,
It is also worth to be noting that neither Joomla nor CB nor CBSubs nor any of our plugins has the "tracking cookies" targetted by the law, it's only cookies needed for performing the visible function required properly.

To be noted also that UK has changed their cookie law fundamentally only hours (like 24 or 48 hours!) before it came into effect, and that most texts referring to it refer to the impossible draft of the law.

Thus, I do believe that Joomla and our cookies do respect the new law. But as a disclaimer, this is only my personal opinion based on what I have read on the subject and this is not legal advice, as I am not a lawyer, and do not reside in the UK.
