We have built the form and the auto action however when the auto action triggers it gives an error saying the user is already registered even though there is no registered user in the DB.

Then it's likely not working correctly. Enable debug mode under the Parameters tab and retry to see what errors are thrown. If none then you're seeing a user store validation error, which means your substitutions probably aren't correct resulting in something like an empty or duplicate username. Username and Email Address are required to be unique by Joomla.
